ReadyTech And The Future Of The Privacy Shield

Arent Fox Privacy, Cybersecurity & Data Protection Associate Jason Sarfati wrote an article in Law360 entitled, “ReadyTech and The Future Of The Privacy Shield,” which analyzes the recent settlement between California-based ReadyTech Corp. and the Federal Trade Commission in connection with allegations that ReadyTech falsely claimed it was pursuing membership in the EU-US Privacy Shield framework.

In the article, Jason points out key elements of the settlement, including the fact that the FTC did not impose any civil or other punitive penalties on ReadyTech, in addition to the FTC’s failure to provide a remedy to European consumers whose personal data was unfairly obtained by ReadyTech.  He also discusses the implications behind the European Parliament’s vote to suspend the Privacy Shield program, and the future of the Privacy Shield program itself.
