Intellectual Property Partner Paul Fakler Interviewed by Digital Music Trends
Arent Fox Intellectual Property partner Paul M. Fakler was interviewed by Digital Music Trends as part of the show’s coverage of the 2014 South by Southwest (SXSW) Music conference. Mr. Fakler, who presented at the conference on “The Digital Music Performance Royalty Apocalypse,” spoke to Digital Music Trends about his session as well as the core issues facing digital music and music copyright.
During the interview, Mr. Fakler discussed the premise of his SXSW session, particularly the history of compulsory rates and rate courts, and the unsustainable high royalty rates that have plagued the music-streaming industry for the last 15 years. He goes on to comment on the latest developments with respect to ASCAP and BMI’s rate courts and about lobbying efforts surrounding Consent Decree.
Among the insight that Mr. Fakler shared with Digital Music Trends, one was about the “huge potential minefield” surrounding pre-1972 sound recordings, which he predicts will be “as big of a problem for the record companies as it is for the services.”
