Michael E. Anderson
Mike has a particular emphasis on the regulatory aspects of health care transactions, and on government investigations of health care providers and related counseling, including the civil and criminal defense of fraud related allegations, the conducting of internal investigations, and the development and implementation of corporate compliance programs.
Mike is particularly experienced in representing providers of long term care and senior living services. He serves as principal outside counsel to several of the nation’s largest long term care companies whose operations include skilled nursing, assisted living, continuing care retirement and independent living facilities, as well as to investor and lender entities involved in complex health care transactions. Mike also serves as counsel to ancillary services providers (physicians, therapists, home health agencies, pharmacies, diagnostic clinics, durable medical equipment suppliers and the like), providers of retirement housing and providers of hospice care.
Mike’s practice includes counseling on a variety of long term care/senior living related business issues including mergers and acquisitions, the conducting of complex regulatory and corporate due diligence, fraud and abuse compliance, survey, certification and licensure matters, construction and financing of long term care and senior living facilities, internal corporate governance/structure issues, Medicare and Medicaid reimbursement, resource contracting, and organization finances, as well as the representation of long term care providers before administrative agencies and the courts.
Mike’s client base also includes both academic and community based general and specialty hospitals, clinical laboratories, pharmaceutical and medical device manufacturers, government health care contractors, and professional and trade associations.
Mike is the immediate past national chairman of the American Bar Association’s Long Term Care Task Force, and is a member of the ABA's Commission on Law and Aging. He is also the former general counsel to the Assisted Living Federation of America where he also chaired the association’s Legal Advisory Committee. Additionally, Mike sits on the American Health Lawyers Association’s Long Term Care Committee and its Fraud and Abuse, Self-Referrals and False Claims Committee. Mike is also a member of the Health Care Contracting Committee and the Procurement Fraud Committee, both of the ABA’s Section of Public Contract Law as well as the Health Law Litigation Committee of the ABA’s Section of Litigation.
Publications, Presentations & Recognitions
Mike is a frequent speaker and author on a variety of health care topics and has written several books on health care related compliance issues, including his most recent publication “Compliance Issues in Gastroenterology.” He was also the longtime author of the monthly legal column for Assisted Living Executive magazine and regularly contributes to various other health care publications.
